Welcome to Banter. These Terms of Service ("Terms") govern your use of the Banter mobile application (the "App") operated by Banter ("we," "our," or "us").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 17 years old to use the App. By using the App, you represent that you meet this age requirement. The App hosts live, user-generated chat that we moderate but do not pre-screen.
We reserve the right to terminate any account we believe belongs to a user under 17 without notice.
You may use the App anonymously or create a registered account. When registering, you agree to:
You may not create accounts for others without their consent, operate more than one account to evade a ban, or impersonate any person or entity.
Anonymous accounts are limited in features and subject to automatic deletion after extended inactivity.
Banter is a real-time sports chat application. It allows users to:
The App relies on third-party sports data (ESPN) and is not affiliated with, endorsed by, or partnered with ESPN, the NFL, NBA, MLB, NHL, or any other sports league or organization.
You agree to use the App only for lawful purposes and in a manner consistent with these Terms. You agree not to:
You may not use the App for commercial solicitation, advertising, or promotion without our prior written consent.
You retain ownership of the messages, photos, and other content you post ("User Content"). By posting User Content, you grant Banter a worldwide, non-exclusive, royalty-free license to store, display, transmit, and moderate that content solely for the purpose of operating the App.
User Content must comply with Section 4 above. We reserve the right (but have no obligation) to review, edit, or remove any User Content at our discretion.
Chat rooms and Sidelines are accessible to other users who join the same room. Do not share sensitive personal information in chats.
We maintain a moderation system to keep the App safe. Moderation actions may include:
We may take these actions with or without prior notice, at our sole discretion. Severity of action depends on the nature and frequency of violations. Bans for egregious violations (e.g., hate speech, harassment, CSAM) may be immediate and permanent.
Appeals: If you believe a moderation action was taken in error, contact us at support@banter.cx. We will review your case but are not obligated to reinstate any account.
You may report users who violate these Terms using the in-app reporting feature. We take reports seriously but cannot guarantee a specific outcome or response time.
The App integrates third-party services including Google Firebase, GIPHY, Sentry, OpenAI, and the ESPN data API. Your use of these services is subject to their respective terms:
We are not responsible for the availability, accuracy, or content of third-party services. Game data from ESPN is provided as-is and may be delayed, inaccurate, or unavailable.
If you grant notification permissions, we may send you push notifications for @mentions. You may disable these at any time in your device's system settings. We will not send promotional push notifications without your separate consent.
The App, including its design, graphics, code, and branding, is owned by Banter and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works of the App without our express written permission.
Team names, logos, and trademarks referenced in the App belong to their respective owners and are used for informational purposes only. Banter is not affiliated with any professional sports league or team.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BANTER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR REPUTATIONAL HARM, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless Banter and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the App; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. You may also stop using the App and delete your account at any time from within the App's settings.
Upon termination, your right to use the App ceases immediately. Sections 5.1, 9, 10, 11, 12, and 14 of these Terms survive termination.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the App shall first be submitted to informal negotiation. If unresolved within 30 days, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in English. Each party shall bear its own costs unless the arbitrator awards otherwise.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.
We may update these Terms at any time. When we do, we will update the "Last Updated" date at the top, and for material changes we may also provide notice within the App. Continued use of the App after the effective date of any change constitutes your acceptance of the revised Terms.
